Terms of Service

These terms apply to photography, video, drone, and 3D tour work provided by Hooked Media ("we", "us") to a client ("you"). Booking a shoot means you accept them.

01What we provide

The services listed on your booking confirmation, which may include interior and exterior photography, twilight photography, aerial drone photography and video, cinematic listing video, short social video, 3D virtual tours, and floor plan measurements.

Anything not listed on that confirmation is not included. If you would like to add services after booking, let us know before the shoot day and we will confirm whether it is possible and what it costs.

02Scheduling and property access

You are responsible for making sure the property is accessible at the scheduled time and ready to be photographed. That means lights working, blinds and curtains as you want them, vehicles moved, bins out of frame, and pets secured.

We do light tidying as part of the job, such as straightening a cushion or moving a stray object. We do not clean, stage, move furniture, or remove clutter.

If we arrive and cannot access the property, or it is not in a condition to shoot, that is treated as a cancellation without notice under section 4.

03Weather

Outer Banks weather is unpredictable, and exterior and aerial work depends on it. If conditions are unsuitable, we will reschedule the affected portion of the shoot at no charge and let you know as early as we can.

Drone flights are also subject to wind, visibility, and airspace restrictions. If a flight cannot be made safely or legally, the drone portion is rescheduled or removed from the invoice.

04Cancellations and rescheduling

You can reschedule at no charge with at least 24 hours notice.

Canceling or rescheduling with less than 24 hours notice, or a shoot that cannot go ahead because the property was inaccessible or not ready, is charged at 50% of the booked amount. This covers the reserved time and any travel already made.

Weather cancellations are never charged.

05Delivery

Edited photographs are typically delivered within 24 hours of the shoot. Video turnaround depends on the scale of the shoot and is always less than one week. 3D tours and floor plans are delivered once processing completes.

All media is delivered through Aryeo, where you can download your files and access your property media at any time. We recommend downloading and keeping your own copies.

If you are working to a specific listing date, let us know when you book and we will confirm whether it is achievable.

06Revisions

If something in the delivered files is not right, let us know within 7 days and we will take care of it. Editing corrections such as color, straightening, or a missed room are made at no charge.

If the issue is on our end, we will make it right. Work requested because the property has changed, because staging was added afterwards, or because the scope of the shoot has changed is quoted as new work.

07Payment

Payment is handled through Aryeo.

For work invoiced directly, invoices are due Net 30 from the invoice date, and a late fee of 5% is applied to outstanding balances every 30 days past due.

North Carolina sales tax is applied at the rate for the client's county.

If an invoice remains unpaid beyond 60 days, the usage license granted in section 8 is suspended until the balance is settled.

08Copyright and how you may use the media

Under United States copyright law, Hooked Media owns the copyright in every image and video we create from the moment it is captured. What you receive is a license to use it, which is broad but not unlimited.

You may use the delivered media in MLS listings, including syndication from the MLS to public listing portals, on your own website, in printed marketing, in email campaigns, on your social media accounts, and in paid advertising for the property or for your own business, for as long as you like. There are no additional usage fees and no expiration.

You may not sell, license, or transfer the media to a third party, including other agents, brokerages, builders, stagers, property managers, or stock libraries. If someone else would like to use the media, please refer them to us.

A credit to Hooked Media is appreciated where a credit is customary, though it is not required.

Editing beyond ordinary cropping and resizing, particularly anything that misrepresents the property, is not permitted, as real estate media is subject to advertising accuracy rules.

09Our use of the media

We keep copies of all work we produce and may use it in our portfolio, on our website, and in our own marketing and social media. This is standard practice for photographers.

If a property is sensitive, or an owner objects, let us know and we will keep it private. No reason is needed.

10Drone operations

All aerial work is flown by a pilot holding a current FAA Part 107 Remote Pilot Certificate, which is the certification required for commercial drone operation in the United States. Flights are carried out in accordance with FAA regulations and any local restrictions in force at the time.

Some Outer Banks locations sit within controlled or restricted airspace and require authorization, which is not always granted. Where a flight cannot legally be made, the aerial portion is removed from the invoice.

11Liability

We take reasonable care in and around your property. We are not responsible for pre-existing damage, for conditions we did not create, or for anything arising from the property being unsafe or inaccessible.

Our total liability for any claim relating to a shoot is limited to the amount paid for that shoot. We are not liable for indirect or consequential losses, including a listing that does not sell, a delayed launch, or lost commission.

You confirm that you have the authority to permit photography of the property, including from the air, and that any owner permissions required have been obtained.

12Governing law

These terms are governed by the laws of the State of North Carolina. Any dispute will be handled in the courts of Dare County, North Carolina.

If a problem comes up, a phone call is usually the fastest way to sort it out.

13Changes

We may update these terms. The version in force is the one published on this page on the date you book. Changes do not apply retroactively to work already booked.
